USPTO Green Technologies Pilot Program
On Monday December 7, 2009, the USPTO announced a Pilot Program for Green Technologies. Under the Pilot Program, up to 3,000 pending applications are eligible to be advanced out of turn for accelerated examination if the application is directed to an invention that materially advanced the quality of the environment, or that materially contributes to: (1) The discovery or development of renewable energy resources; (2) the more efficient utilization and conservation of energy resources; or (3) greenhouse gas emission reduction.
Eligible applications need not provide a pre-filing search and disclosure Examination Support Document, and the petition fee for a Petition to Make Special is being waived. Eligible applications must have been pending before December 8, 2009, and not have received any Office Action. Requests for participation in the Green Technologies Pilot Program must include a request for early publication of the application. Green Technologies are defined as those falling within a set of Patent Classification subclasses concerning Alternative Energy Production; Energy Conservation; Environmentally Friendly Farming; and Environmental Purification, Protection or Remediation.
